Reading it, one might think that the Courts make an assessment of the significance of each area and decide who would be best at regulating it. That is not what occurs. The proposition states a necessary but not a sufficient condition for recognition of a power as falling under this branch of the residue.
In Cunliffev. Commonwealth (1994) 182 CLR 272, 322 and BlackshieldAVilliams, Australian Constitutional Law, p. 656, state that this 'aspect' of the external affairs power is purposive.
